1. Nature of the Service: a behavioural tool, not advice

Junglezone Trader is a decision-support tool for self-reflection and for studying behavioural patterns in trading. The Service does not constitute investment advice, investment marketing or portfolio management as defined in the Israeli Regulation of Investment Advice Law, 1995, and is no substitute for advice that considers your personal circumstances. The Operator is not licensed as an adviser. The Service is likewise not psychological treatment, diagnosis or medical advice.

• The Service never executes, transmits or cancels trades for you, and is not authorised to do so.
• The Service never blocks, delays or prevents any trade. Every action in your brokerage account is taken by you alone, at your broker.
• Broker connections, where offered, are read-only and grant the Service no execution capability.
• All content: scores, metrics, insights, charts and alerts, is general information and not a recommendation to act.

2. Eligibility and acceptance

Use of the Service is permitted from age 18 only, by persons with legal capacity. You must provide accurate details at registration and keep them current. An account is personal and non-transferable. Ticking the consent box at sign-up, or continued use of the Service, constitutes binding clickwrap acceptance of these Terms, the Privacy Policy and any duly published update.

3. Beta version

The Service is currently offered as a beta: it is provided for trial and improvement and has not completed full testing. Errors, inaccuracies, material feature changes, downtime and even loss or reset of data may occur. We recommend independently backing up anything important. Nothing here derogates from the remaining Terms, including the limitation of liability.

4. Consideration and payment

During the beta the Service is provided free of charge. The Operator may launch paid plans in the future; moving to a paid plan will occur only with your explicit consent, on at least 30 days' notice, and its terms, including cancellation and refunds, will comply with the Israeli Consumer Protection Law, 1981. Not joining a paid plan will not derogate from rights lawfully accrued.

5. Market data and third-party content

Market data, prices, charts and news are supplied by third parties and may be delayed, partial, inaccurate or unavailable. The Operator does not warrant their accuracy, currency or continuity, and is not responsible for any decision made in reliance on them. Do not use this data as a substitute for an official source.

6. AI-generated content ("the Owl")

Some content is produced by artificial intelligence. Such content may be wrong, partial or outdated, and does not constitute a recommendation, advice or a professional opinion. Full responsibility for evaluating and using any such content rests with you alone.

7. Your responsibility and trading risk

Trading involves real risk, including loss of all capital. Every trading decision, entry, exit, sizing, stops, is yours alone and at your sole responsibility. Past performance, behavioural metrics and scores are no guarantee of future results. You confirm that you have not relied and will not rely on the Service as a source of advice, and that you will consult an appropriately licensed professional for any investment, tax or legal question.

8. Prohibited uses

The Service may not be used unlawfully or abusively, including:

• Circumventing security measures, reverse engineering, scraping or deliberate overloading.
• Copying, distributing or commercially exploiting Service content without written permission.
• Impersonation, providing false information or using another person's account.
• Posting content in the community that violates law, misleads, harms, or constitutes unlicensed investment advice.
• Using the Service to build a competing product.

9. User content

Content you enter (journal, notes, posts) remains yours; you grant the Operator a non-exclusive licence to use it for operating and improving the Service. You are solely responsible for content you publish, and the Operator may remove infringing content at its discretion, without prior notice.

10. Intellectual property

All rights in the Service: including code, design, metrics, algorithms, trademarks and content (excluding user content and third-party data), belong to the Operator or its licensors. You receive only a personal, limited, revocable, non-commercial licence to use the Service.

11. Limitation of liability

The Service is provided As-Is and As-Available, without any representation or warranty, express or implied, including fitness for purpose, reliability, availability or accuracy. To the maximum extent permitted by law, the Operator, its officers, employees and suppliers shall not be liable for any damage, direct, indirect, consequential, special or punitive, including trading losses, lost profit, data loss or reputational harm, arising from use of or inability to use the Service. Without derogating from the above, the Operator's total aggregate liability, if imposed notwithstanding, shall not exceed the amount you actually paid for the Service in the 12 months preceding the event, and absent payment, NIS 100. Nothing in these Terms derogates from rights that cannot be waived by law.

12. Indemnification

You undertake to indemnify the Operator for any damage, expense or third-party claim (including reasonable legal fees) arising from your breach of these Terms, content you entered, or your unauthorised use of the Service.

13. Termination, suspension and changes

The Operator may suspend or terminate access to all or part of the Service at any time, including for breach, legal requirement or operational reasons, and may change or discontinue features. You may stop using the Service and request account deletion at any time. Provisions intended by nature to survive (IP, limitation of liability, indemnification, governing law) shall continue to apply.

14. Changes to these Terms

The Operator may update these Terms from time to time. The current version will be published on this page with a date and version number; material changes will be announced in the system. Continued use after an update constitutes acceptance of the updated text.

15. Force majeure

The Operator shall not be liable for non-performance or delay caused by circumstances beyond its reasonable control, including infrastructure or communication failures, third-party provider failures, cyber-attacks, war, hostilities, a state of emergency, strikes or an order of a competent authority, provided it acted reasonably to mitigate the harm.

16. Assignment and notices

You may not assign or transfer your rights or obligations under these Terms without the Operator's written consent. The Operator may assign them as part of a merger, acquisition or transfer of business, provided your rights are not prejudiced. Notices will be delivered to the email you provided or by an in-system message, and are deemed delivered within 24 hours of dispatch; notices to the Operator, to modernyzgroup@gmail.com.

17. Funded-account companion ("Phase")

The Service lets a user record and track a funded trading account or evaluation challenge conducted with a third party. It is clarified that: (a) the challenge's rules, including targets, loss limits and trading days, are entered solely by the user, who is responsible for verifying them with the relevant firm; (b) the Company is not connected to, affiliated with or acting in cooperation with any funding firm, and a trade name mentioned by the user implies no sponsorship or endorsement; (c) all calculations are based solely on trades the user logged, with no live connection to the trading account, and constitute an informational approximation only; (d) determining whether challenge conditions were met rests solely with the funding firm, and the Service does not promise, expressly or impliedly, the passing of any stage or challenge; (e) nothing in this feature constitutes investment advice, an inducement to trade, or a substitute for independent judgment.

18. Governing law, jurisdiction and miscellaneous

These Terms are governed solely by the laws of the State of Israel, and exclusive jurisdiction is vested in the competent courts of the Tel-Aviv-Jaffa district. If any clause is held invalid, the remaining clauses stand, and the clause will be replaced by a valid provision closest in purpose. Non-enforcement of a right is not a waiver.
